1. General
1.1 These general terms and conditions apply to all offers, quotations, services, and agreements related to the services provided by Walks and More, hereinafter referred to as "Service Provider".
1.2 Deviations from these terms and conditions are only binding if agreed upon in writing.
2. Services
2.1 The Service Provider offers the following services:
- Travel Advice: Tailored advice based on the client’s wishes, ideas, and budget. The client is responsible for booking the trip and any additional services they choose.
- Remote Administrative Assistance: Providing administrative support to small businesses.
2.2 The Service Provider offers advice and information but is not responsible for the execution of bookings or the quality of services provided by third parties.
3. Formation of the Agreement
3.1 Travel Advice: The agreement is concluded once the client agrees to the offer from the Service Provider and has made full payment in advance. Work for travel advice will only commence once full payment has been received.
3.2 Administrative Assistance: The agreement is concluded as soon as the client agrees to the proposal of the Service Provider. The client and Service Provider shall record the arrangements in writing, including either a project price or hourly rate. Payment is made based on the services provided, with monthly invoicing or according to another agreed payment schedule. The client receives a monthly invoice for the hours worked or the agreed portion of the project price.
4. Rates and Payment
4.1 Travel Advice: Rates for travel advice are fixed in advance and must be paid in full before the Service Provider begins any work. The client receives an invoice for the full price of the travel advice.
4.2 Administrative Assistance: For administrative services, including either a project price or hourly rate. a project price or hourly rate is agreed upon. Payment is based on the services rendered. Invoicing takes place monthly or according to another pre-agreed schedule. The client receives an invoice at the end of each billing period for the hours worked or the agreed portion of the project price.
4.3 All prices mentioned are excluding VAT,unless stated otherwise. Payment must be made within the period stated on the invoice.
5. Cancellation and Withdrawing
5.1 Travel Advice: Due to the nature of the service (custom work), the client cannot withdraw from the agreement once payment has been made and work has begun, as specified in the Dutch Distance Selling Act (Article 6:230o of the Dutch Civil Code).
5.2 Administrative Assistance: Cancellation of administrative services is possible, but the client is obliged to pay for work already performed up to the moment of cancellation. In case of a project, cancellation fees may be charged, depending on the progress of the project. The cancellation fees are calculated as follows:
- For monthly invoiced administrative services, a 30-day notice period applies.If the client cancels the contract within the month, the full monthly amount will be invoiced.
- If the cancellation occurs before 50% of the work has been completed,25% of the agreed project price will be charged as a cancellation fee.
- If the cancellation occurs after 50% but before 75%,25% 50% of the agreed project price will be charged. will be charged as a cancellation fee.
- If the cancellation occurs after 75% of the work has been completed,25% 75% of the agreed project price will be charged. will be charged as a cancellation fee.
6. Liability
6.1 The Service Provider is not liable for any damages resulting from not following or only partially following the provided advice, nor for damages resulting from the execution of the booked trip by third parties.
6.2 The liability of the Service Provider is in all cases limited to the amount paid by the client for the respective service, with a maximum equal to the total amount due under the agreement.
7. Intellectual Property
7.1 All advice, documents, designs, and materials provided by the Service Provider remain the property of the Service Provider unless otherwise agreed in writing.
7.2 The client is not entitled to share, distribute, or commercially use the provided materials without the written permission of the Service Provider.
8. Privacy
8.1 The Service Provider processes personal data in accordance with the General Data Protection Regulation (GDPR). See also the privacy policy.
9. Applicable Law
9.1 All agreements are governed by Dutch law.
9.2 All disputes arising from or related to the agreement will be submitted to the competent court in the Netherlands, unless the parties mutually agree to choose a different forum.
